CHAPTER 6 – PREFERENCIAL TREATMENT

It is the benefit given to a certain good that, when accompanied by a certificate of origin, enjoys from a reduction or elimination of customs duties in the import.

Certificate of origin is the document that proves the origin of goods for the purposes of obtaining a preferential tariff treatment. For each agreement there is a specific Certificate of Origin, that is, there are laws, regulations, rules and/or administrative provisions of general application used specifically by the countries in determining the criteria for the origin of goods.

To import with a certificate of origin the importer has to purchase goods from suppliers authorized to export under the scope of the Agreement for which they have adhered to and the supplier should give the gods accompanied by a certificate of origin.

To benefit from the preferential treatment the importer should be registered as a foreign trade operator, licensed for that effect, by the Ministry of Industry and Trade.

To benefit from the preferential treatment the exporter should get registered with the Ministry of Industry and Trade – Directorate of Industry as a producer and/or exporter   authorized to export with a Certificate of Origin and comply with the rules of origin foreseen in the agreement that they intend to use.

The preferential treatment referred is based in agreements that the countries have signed and ratified for the goods to enjoy exemption from the most-favoured-nation (MFN) rules of origin, that is, it allows for a more favourable treatment and this can be translated into a reduction on the tariff levels, more favourable licensing conditions in licensing processes on imports, special commercialization conditions, etc. In the imports or exports among the countries that are signatory to the agreement.

The certificate of origin should be presented at the moment of submission of the customs declaration and the other supporting documents necessary for importing/exporting, at the customs office of clearance.

  • The SADC Certificates of Origin can be issued in Portuguese;
  • The Certificates of Origin of the Bilateral Agreements, European Union and AGOA can be issued in Portuguese or English;
  • The Certificates of Origin of the Agreement with China should be issued only in English.
